1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the DhimsonHire.com website and related services operated by Dhimson Tradespot Private Limited (“we,” “our” or “us”). By accessing or using the Platform, creating an account, posting or applying to jobs, purchasing courses or subscriptions, redeeming coupons or rewards, or otherwise using any services on the Platform, you agree to be bound by these Terms. If you do not agree, you should not use the Platform. We may modify these Terms at any time by posting the updated version on the Platform. Continued use after an update constitutes acceptance of the modified Terms.

2. Scope of Services

  1. Recruitment Platform: The Platform enables candidates to create profiles, upload résumés, search and apply for job listings and receive job alerts. Employers can create accounts, post job openings, search for candidate profiles and contact applicants who apply or whose profiles match the employer’s criteria. DhimsonHire acts as an intermediary to facilitate connections but does not participate in employment contracts or guarantee hiring decisions.
  2. Premium and Paid Services: We offer premium features and subscription plans for both candidates and employers. For candidates, premium services may include enhanced profile visibility, priority application placement and access to exclusive job listings. For employers, subscription plans may include expanded candidate search, analytics, résumé downloads and direct contact functionality. Fees for these services are displayed on the Platform and must be paid in advance; prices may change and will apply to future purchases.
  3. E‑Learning Marketplace: Users may purchase access to online courses offered by third‑party providers. When you purchase a course, you enter into a contract with the course provider, and that provider’s terms and policies apply. DhimsonHire facilitates payment and access but does not guarantee the quality or accuracy of course content and will not provide refunds on behalf of course providers.
  4. Tools and Calculators: We provide calculators (e.g., salary, gratuity), a résumé builder and other career‑related tools for informational purposes. Results generated by these tools are estimates and should be verified with qualified professionals. There is no refund for these tools.
  5. College and Agent Services: Educational institutions and authorised recruitment agents may create institutional accounts to upload candidate profiles and manage applications. Institutions and agents must obtain data principals’ consent before uploading information and must ensure accuracy. Agents must comply with applicable recruitment laws and may not charge candidates undisclosed fees.
  6. Surveys and Feedback: We may invite users to participate in surveys and questionnaires. Participation is voluntary. Aggregate results may be shared with employers or course providers but individual responses will not be disclosed without consent.
  7. Third‑Party Advertising and Sponsored Content: The Platform may display advertisements or sponsored listings from third‑party advertisers. Advertisements may be personalised using cookies; users will be given clear notice and an opportunity to opt out of non‑essential cookies. We do not endorse or guarantee third‑party products or services and are not responsible for your interactions with advertisers.
  8. Social Login Integration: You may register or sign in using third‑party authentication providers (e.g., Google, LinkedIn). By using social login, you authorise us to access certain profile information (name, email, profile picture) needed to create your account. We do not store your social login credentials and will not post content on your behalf without consent. Your use of third‑party login is subject to these Terms and the third‑party provider’s terms.
  9. International Access: The Platform is operated from India but may be accessed worldwide. You are responsible for complying with local laws and professional requirements in your jurisdiction. When you use the Platform from outside India, you consent to the transfer and processing of your data in India as described in our Privacy Policy. Users in jurisdictions with additional privacy requirements (e.g., the European Union) should review local laws; we will endeavour to honour those obligations to the extent consistent with Indian law and cross‑border restrictions.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Platform, you represent that you meet these requirements and are not prohibited from using the Platform under applicable laws.

4. User Responsibilities

  1. Candidates: You agree to provide truthful and current information when creating profiles, uploading résumés and applying for jobs. You will maintain the confidentiality of your login credentials and are responsible for all activities under your account. You must not:
    • Use the Platform for unlawful purposes or post content that is offensive, discriminatory or misleading.
    • Share personal data of other users without their consent.
    • Create multiple accounts or impersonate another person.
    • Engage in spam, phishing, fraud or any activity that violates law or infringes rights.
  2. Employers: You agree that job postings will be accurate, lawful and compliant with labour and anti‑discrimination laws. Employers may only use candidate information for legitimate recruitment purposes and must not discriminate on the basis of caste, religion, gender, marital status, disability or other protected characteristics. You must not:
    • Post jobs that require candidates to pay to apply or that violate law.
    • Disclose candidate data to unauthorised parties or use it for purposes unrelated to recruitment.
    • Misrepresent job roles, compensation or working conditions.
    • Contact candidates outside the Platform unless they have provided consent or applied to your posting.
  3. Institutions and Agents: Colleges, universities and agents must obtain explicit consent from each candidate before creating a profile. They must ensure that information provided is accurate and must not share candidate data outside the Platform without consent. Agents must comply with data‑protection and recruitment laws and cannot charge undisclosed fees.

5. Reward and Coupon Policy

DhimsonHire may occasionally offer promotional coupons, discount codes or reward points (collectively, “Promotions”) that can be redeemed against subscription fees, consulting services or courses. By participating in a Promotion, you agree to the following terms:

  1. Eligibility and Use: Promotions are valid only for the services and time period specified in the offer. Each promotion will describe eligibility criteria (e.g., new users, specific subscription plans), the redemption process and any minimum purchase requirements. Promotions are non‑transferable, cannot be redeemed for cash and may not be combined with other offers unless stated.
  2. Transparency and Fairness: Under the E‑commerce Rules, e‑commerce entities must avoid unfair discrimination between consumers. DhimsonHire will not arbitrarily restrict promotions to specific users without a reasonable basis. Any classification (such as student‑only discounts) will be explained in the promotional materials. We will refrain from marketing offers as “free” where additional costs (e.g., handling or registration fees) apply, in line with the Guidelines for Prevention of Misleading Advertisements.
  3. Stock and Availability: For promotions tied to limited‑quantity services or courses, we will ensure adequate supply to meet foreseeable demand and will clearly state any geographic or age‑based restrictions. If supply is exhausted, we reserve the right to cancel the promotion without liability.
  4. Redemption on Third‑Party Sites: Some coupons may be redeemable on partner websites. Redemption will be subject to the partner’s terms, and DhimsonHire is not responsible for the partner’s products or services. We do not guarantee that third‑party sites will accept the coupon beyond the stated validity period.
  5. Modification and Termination: DhimsonHire reserves the right to modify or cancel any Promotion at any time without liability. In the event of suspected fraud or abuse, we may withhold or cancel rewards.

6. Payment, Subscription and Fees

Fees for subscriptions and premium services must be paid via our third‑party payment providers. All payments are subject to the provider’s terms. You authorise us to charge the applicable fees to your selected payment method. Taxes, as applicable, will be charged in accordance with Indian tax law. Fees are non‑refundable except as specified below or as required by law.

7. Refunds and Cancellations

  1. Courses and E‑learning: Refunds for courses are governed by the respective course provider’s policy. We will forward your request to the provider but cannot guarantee a refund.
  2. Subscription Plans and Premium Services: Subscription fees are generally non‑refundable once the service period begins. We may, at our discretion, provide a prorated refund if a verified service failure prevents you from using your subscription. Details of refund eligibility are provided at the time of purchase.
  3. Promotions and Rewards: Coupons and reward points have no cash value and are not refundable. If you cancel a service for which a promotion was used, any promotional value may be forfeited.

8. Intellectual Property

All content on the Platform—text, graphics, logos, icons, software and other materials—is owned by DhimsonHire or its licensors. You may not reproduce, modify, distribute or create derivative works without prior written permission. Employers retain ownership of their job descriptions and logos; candidates retain ownership of their résumés; course providers retain ownership of course content. By uploading content, you grant us a non‑exclusive, worldwide, royalty‑free licence to use, reproduce and display that content for the operation and marketing of the Platform.

9. Disclaimers

We provide the Platform and services “as is” and “as available”. While we strive to maintain accurate listings and course information, we do not warrant that the content is complete, reliable or error‑free. DhimsonHire does not guarantee that you will obtain a job, that a candidate will accept an offer, or that any course will meet your expectations. Calculators and tools are for general guidance and should not be considered financial, tax, legal or HR advice; users should consult professionals for personalised advice. Advertisements and promotions are provided in compliance with consumer protection and advertising laws, but we do not endorse third‑party products or services.

10. Limitation of Liability

To the fullest extent permitted by law, DhimsonHire and its directors, officers, employees and agents are not liable for indirect, incidental, consequential or special damages arising out of or related to your use of the Platform, including loss of employment, lost profits, loss of data or business interruption. Our aggregate liability for any claim is limited to the amount of fees you paid to us in the twelve months preceding the claim.

11. Indemnity

You agree to indemnify and hold harmless DhimsonHire, its affiliates, officers, directors, employees and agents from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms or your violation of any law or rights of a third party.

12. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, if we determine that you have violated these Terms or engaged in unlawful or abusive conduct. You may close your account at any time by contacting support. Upon termination, your right to use the Platform ceases immediately; however, certain provisions (e.g., intellectual property, liability, indemnity) survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from or relating to the Platform or these Terms shall be subject to the exclusive jurisdiction of the courts of Noida, Uttar Pradesh, India. Nothing herein restricts our ability to seek injunctive or equitable relief in other jurisdictions to enforce our rights.
